Terms of Service for Paws & Whiskers Haven Singapore

1. Introduction and Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of the services, programs, website, communications, facilities, and related offerings provided by Paws & Whiskers Haven Singapore (“we,” “us,” or “our”), a cat-shelter business operating in Singapore.
By accessing, engaging, donating to, volunteering with, applying for adoption through, fostering for, or otherwise using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and any policies referenced herein. If you do not agree, you must not use our services.
Where you act on behalf of another person, organisation, or entity, you represent and warrant that you have the authority to bind that person, organisation, or entity to these Terms.
2. Scope of Services
Paws & Whiskers Haven Singapore may provide some or all of the following services, subject to availability, suitability assessments, operational capacity, and applicable law:
- Cat rescue and intake;
- Health screening and basic veterinary coordination;
- Temporary foster care placement;
- Adoption matching and home suitability checks;
- Kitten socialization and behavioral support;
- Community cat welfare assistance; and
- Volunteer and donation programs.
We may modify, suspend, or discontinue any service at any time, with or without notice, where reasonably necessary for animal welfare, safety, legal compliance, resource constraints, or operational reasons.
Our services are welfare-oriented and are not a substitute for professional veterinary diagnosis, treatment, emergency care, legal advice, or other professional services. Any veterinary services are limited to coordination and support unless expressly stated otherwise.
3. User Obligations and Responsibilities
You agree to provide accurate, complete, and current information when interacting with us, including adoption applications, foster applications, volunteer registrations, donation records, and any welfare-related reports.
You must:
- Comply with all applicable Singapore laws, regulations, and public health requirements;
- Treat all animals, staff, volunteers, foster carers, adopters, and members of the public with respect and care;
- Follow all instructions, safety requirements, and welfare protocols issued by us;
- Ensure that any premises, transport, equipment, or materials you provide are safe and suitable for the intended purpose;
- Promptly disclose any known medical, behavioural, or environmental risks relevant to an animal’s care or placement;
- Not abuse, neglect, abandon, harass, exploit, or mistreat any animal;
- Not interfere with rescue, intake, foster, adoption, or welfare operations; and
- Not use our services for unlawful, fraudulent, or harmful purposes.
If you are applying to adopt or foster an animal, you acknowledge that approval is discretionary and may be subject to interviews, home checks, reference checks, follow-up checks, and other suitability assessments. We may reject or revoke approval where we reasonably believe it is in the best interests of the animal or required for safety or compliance.
You are responsible for supervising children, guests, and any other persons under your care when interacting with animals or participating in our programs.
4. Payment Terms and Conditions
Unless otherwise stated, fees, deposits, donations, reimbursements, and other charges are payable in Singapore dollars (SGD) using the payment methods we make available from time to time.
Where fees apply, they may include, without limitation, adoption fees, foster-related contributions, medical cost contributions, transport charges, administrative fees, event fees, or other service-related charges. All fees are non-cash and subject to change at our discretion, unless a written agreement states otherwise.
Payments must be made in full by the stated due date. We may withhold, suspend, or cancel services, placements, or participation where payment is overdue or where a payment is reversed, disputed, or suspected to be fraudulent.
Donations are generally non-refundable unless required by law or expressly approved by us in writing. If a donation is made in error, please contact us promptly. We may request supporting documentation before considering any refund or correction.
If we incur costs on your behalf, including veterinary coordination, transport, supplies, or emergency welfare expenses, you agree to reimburse us where such costs were pre-approved by you or otherwise agreed in writing.
5. Cancellation and Refund Policy
Cancellations for appointments, visits, volunteer sessions, adoption meetings, foster placements, or other scheduled activities should be made as early as possible by contacting us directly.
We reserve the right to cancel or reschedule any service, appointment, or placement due to animal welfare concerns, safety issues, insufficient information, non-compliance, operational constraints, or events beyond our control.
Unless otherwise required by law or expressly stated in writing:
- Administrative fees are non-refundable;
- Donations are non-refundable;
- Adoption fees may be non-refundable once an adoption is completed or where costs have already been incurred;
- Foster-related contributions may be non-refundable once resources, supplies, or placements have been arranged; and
- Refunds, if any, are issued at our sole discretion after review of the circumstances and supporting evidence.
Where a refund is approved, it will generally be processed using the original payment method within a reasonable time, subject to banking and payment processor timelines.
6. Liability Limitations
To the fullest extent permitted by Singapore law, Paws & Whiskers Haven Singapore, its directors, officers, employees, volunteers, agents, and contractors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive losses or damages, including loss of profits, loss of opportunity, reputational harm, or emotional distress, arising out of or in connection with your use of our services.
While we take reasonable care in the rescue, handling, assessment, placement, and welfare of animals, you acknowledge that animals may behave unpredictably and may carry inherent risks, including scratches, bites, allergic reactions, property damage, illness, injury, stress, or behavioural issues. You assume all risks associated with interacting with animals, except to the extent caused by our proven negligence or wilful misconduct and only to the extent such liability cannot be excluded under applicable law.
We do not guarantee:
- That any animal will be suitable for a particular home, environment, or purpose;
- That any animal will remain healthy, calm, or free from medical or behavioural issues;
- That adoption, fostering, or matching outcomes will be successful;
- That our website, communications, or systems will be uninterrupted or error-free; or
- That all information provided by third parties, including prior carers or members of the public, is complete or accurate.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded under Singapore law, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence where such exclusion is prohibited.
7. Intellectual Property Rights
Unless otherwise indicated, all content created, published, or made available by Paws & Whiskers Haven Singapore, including text, graphics, logos, photographs, videos, designs, documents, forms, and program materials, is owned by or licensed to us and is protected by applicable intellectual property laws.
You may not copy, reproduce, modify, distribute, republish, display, transmit, create derivative works from, or commercially exploit our content without our prior written consent, except as permitted by law.
If you submit photographs, testimonials, stories, feedback, or other materials to us, you grant us a non-exclusive, worldwide, royalty-free, transferable, sublicensable licence to use, reproduce, adapt, publish, and display such materials for operational, promotional, educational, fundraising, and welfare-related purposes, subject to applicable law and any written restrictions you provide and we accept.
8. Data Protection and Privacy
We collect, use, disclose, and store personal data in accordance with the Singapore Personal Data Protection Act 2012 (“PDPA”) and our internal data protection practices.
By using our services, you consent to our collection, use, disclosure, and processing of your personal data for purposes reasonably connected with our operations, including:
- Processing adoption, foster, volunteer, donation, and welfare applications;
- Contacting you regarding services, appointments, updates, and follow-ups;
- Conducting suitability checks, reference checks, and home assessments;
- Coordinating veterinary, transport, rescue, and welfare arrangements;
- Maintaining records and fulfilling legal, accounting, and reporting obligations;
- Managing safety, security, fraud prevention, and dispute resolution; and
- Sending service-related communications and, where permitted, fundraising or promotional communications.
We may disclose personal data to veterinarians, foster carers, adopters, volunteers, service providers, payment processors, regulators, law enforcement, or other third parties where necessary for the purposes above, or where required or permitted by law.
You are responsible for ensuring that any personal data you provide to us is accurate and that you have obtained any necessary consent from third parties whose data you share with us. 9. Force Majeure
We shall not be liable for any delay, failure, or interruption in performing our obligations where such delay or failure results from events beyond our reasonable control, including but not limited to natural disasters, fire, flood, epidemic, pandemic, disease outbreaks, civil unrest, strikes, labour disputes, power failures, internet outages, transport disruptions, government actions, regulatory changes, or acts of God.
In such circumstances, we may suspend, modify, or terminate affected services without liability, and we will use reasonable efforts to resume operations as soon as practicable.

13. Severability Clause

Where possible, any invalid, unlawful, or unenforceable provision shall be replaced with a valid and enforceable provision that most closely reflects the original intent of the parties and the commercial purpose of these Terms.
